Court rules for bank in £20m transfer of property case

Supreme Court ruled in favour of UAE based Invest Bank, dismissing argument by El-Husseini family on interpretation of s423 of Insolvency Act

In dispute at the Supreme Court was the validity of the transfer of various high value properties in London from companies owned by El-Husseini to his sons. 

The appeal revolved around a ‘single and important point’ related to the ‘construction’ of section 423 of Insolvency Act 1986, involving £20m of transactions in London properties.

In 2021 Invest Bank PSC, headquartered in Sharjah, had obtained a judgment in Abu Dhabi against the appellants’ father, Ahmad El-Husseini, for approximately £20m (AED96m), which the bank described as a ‘worldwide asset dissipation scheme to defeat his creditors’.

The judgment debt arose under guarantees given by El-Husseini for credit facilities granted by Invest Bank to two companies connected with him, and litigation started in London in July 2021 to enforce the judgments.
