The High Court hearing saw the legal team for the government, defending chancellor Rachel Reeves, set out in their skeleton argument that children in private education are ‘by proxy’ wealthy, but statistics shared with the panel of three judges claimed 25% of private school parents were not wealthy.

Additionally, 19% of students represented by the Independent Schools Council (ISC) have some form of special educational needs and disabilities (SEND) and need a higher standard of education only accessed through private schools.
