CGT: don’t hit entrepreneurs with tax rate hike

The OTS capital gains tax reveals where there can be an arbitrage between CGT and income taxes, but the government should think carefully before introducing measures which significantly hurt the entrepreneur, argues Gary Ashford, tax partner at Harbottle and Lewis

On 11 November 2020 we saw the publication of the Office of Tax Simplification’s (OTS) report on capital gains tax (CGT). This was on the back of a consultation launched in July by Chancellor Rishi Sunak in an attempt to fill the fiscal hole left by paying for the Covid-19 crisis.

Over the years we have seen many consultations on tax matters, many from OTS as well as HMRC or the Treasury. However, while not the most contentious, this document attracted significant discussion, not all positive.
