FSA challenge in Ceart Risk Services case

The Financial Services and Markets Act 2000 (FSMA) requires that where an administrator is appointed to a company authorised by the Financial Services Authority, the prior approval of the FSA is obtained. Unfortunately, in Re Ceart Risk Services Ltd [2012] EWHC 1178 (Ch) this requirement was overlooked.
