Bluecrest LLP loses £100m tax appeal

Bluecrest Capital Management LLP has once again lost an appeal over the tax status of members of the partnership due to lack of influence over business

The Upper Tribunal has upheld the decision of the First Tier Tribunal (FTT) in the salaried members rules case, ruling that the members of the limited liability partnership (LLP) were liable for income tax and National Insurance contributions.

It agreed with the FTT’s ruling that certain individual LLP members did hold significant influence over the affairs of the partnership.

BlueCrest Capital Management LLP, the appellant, was an alternative investment firm providing investment management and back-office services.
