Criminal convictions and employment

The Disclosure and Barring Service, commonly known as CRB, should only be used when it is applicable to the job and with the employee’s explicit consent

For example, employers are not even permitted to ask for an enhanced DBS Check (with or without barred details) unless the job advertised is categorised as a ‘regulated activity’ profession. 

The Ministry of Justice disclosed that 1 in 4 people of working age in the UK have a criminal record so this situation is not uncommon.

Spent and unspent convictions differ in employment law. Unspent convictions must be disclosed when asked.
