Denmark loses ‘flimsy’ £1.4bn dividend tax case

High Court rules against Danish tax authorities over £1.4bn cum-ex dividend refunds case, saying controls for paying claims were ‘so flimsy as to be almost non-existent’

At the High Court, the Danish customs and tax administration (Skat) brought a case against Solo Capital Partners LLP, arguing the tax authority had been ‘misled by misrepresentations made to it through the tax refund claims it received’. They said they had been ‘deceived into paying tax rebates’ on a vast cum-ex trading scheme involving dividend tax refunds between 2012 and 2015.

One of the main individuals involved in the activities about which SKAT complained is Sanjay Shah, who founded his Solo Capital group in London in 2009, and is now serving a sentence in Denmark over the scheme.
