The ICAEW has won a High Court injunction against a previous member who continued to be known as ACA qualified despite his membership ending in 2014 because of his failure to comply with continuous professional development requirements
Alan Brookes and his firm, Brooke O’Hara Ltd, infringed EU trade marks by passing themselves off as members of the ICAEW. On the Brookes O’Hara website (www.brookes-accountants.co.uk) he displayed the ICAEW logo as well as stating that he was an ICAEW chartered accountant, despite no longer being allowed to do so.
Brookes’ ICAEW membership was taken away in 2014 after he failed to certify compliance with his continuing professional development between 2010 and 2012, and was ordered to pay fines and costs of £3,700.
Brookes and his firm were ordered by the court to display a statement announcing the injunction on the website for six months, however the website has now been taken down.
They were also ordered to pay costs totalling £7,800.
