Pension Protection Fund criteria for insolvency professionals

The Pension Protection Fund (PPF) has updated its general guidance for restructuring and insolvency professionals restructuring pension schemes following a number of high profile and problematic restructures. Devi Shah & Lauren Theodoulou of Mayer Brown International review the guidance

The Pension Protection Fund (PPF) has once again updated its general guidance for restructuring and insolvency professionals and its booklet on the PPF's approach to employer restructuring.

Although the guidance documents were updated earlier this year, the PPF has recently come under increasing scrutiny following a number of high profile restructurings. This included the restructuring of the Halcrow Group, owned by its US owner CH2M Hill (CH2M), in July. The PPF noted that in this instance the restructuring had in some places had been ‘inaccurate and occasionally even potentially misleading’.
