All employers must follow the Code and it provides a framework for Employment Tribunals to use when deciding whether an employer has acted fairly. Getting it wrong can push up the compensation an employee is awarded.
The Acas Code review comes alongside the introduction of new unfair dismissal rules from January 2027 with the move to a six-month maximum probation period under the Employment Rights Act 2025, another major change for employers.
