In an unusual move, the First Tier Tribunal (FTT) agreed to give the appellant anonymity after he persuaded the judge that his extended family who lived in a foreign country would have their lives put at risk if his name was revealed as they had sent him large amounts of money ‘secretly’.

With no legal representation, Mr E, who had come to the UK over 40 years ago as a student, said his extended family lived in a country ‘with a poor record regarding human rights’ and the fact they sent him hundreds of thousands of pounds over the last few decades could be a problem.

The tribunal allowed his anonymity claim despite tribunal judge Anne Fairpo stressing that ‘open justice’ was important, stating: ‘We are conscious that the starting point for applications such as these is that of open justice: justice must be done in public.’
