Implications of new tax year

April sees the start of a new tax year and also a raft of measures taking effect such as the restriction of loss relief, the new patent box regime, simpler income tax for small businesses among others. However, as new law comes into force, recent decisions provide clarification of existing measures.

No double tax relief in Anson

In HMRC v Anson [2013] EWCA Civ 63, the Court of Appeal has upheld the Upper Tribunal’s decision that double tax relief is not available on the taxpayer’s share of profits in a Delaware limited liability company (LLC).
