US Judge orders refunds for $130bn Trump tariffs

Exactly two weeks after Supreme Court invalidates president Trump’s Liberation Day tariffs, New York Judge orders refunds to be issued to importers with added interest

In the latest blow for the tariff policy, a Judge at the US Court of International Trade has ruled: ‘All importers of record whose entries were subject to IEEPA duties are entitled to the benefit from the Supreme Court’s ruling.’

On 20 February, in a six to three majority ruling, the Supreme Court ruled tariffs on products entering the US were not allowed using the International Emergency Economic Powers Act 1977 (IEEPA). The ruling applied to all Liberation Day tariffs announced on 2 April 2025, so-called Liberation Day.

Now refunds will have to be made by US Customs and Border Protection.
