CJEU backs UK on discretionary fund portfolio management
The CJEU decision in the case of Deutsche
Bank (C-44/11) appears to have confirmed the UK’s general

investors, on a non-collective basis. It therefore seems to fall outside
the exemption for open-ended investment schemes.
