Deloitte hearing on MG Rover re-opens

Deloitte appears today before a Financial Reporting Council (FRC) disciplinary tribunal in a resumption of the hearing over allegations of misconduct in its role as auditor to MG Rover prior to the company's administration in 2005.

The hearing began in March, and centres on claims that Deloitte and ex-partner Maghsoud Einollahi failed to manage conflicts of interest in its advice to MG Rover and four directors, John Towers, Nick Stephenson, Peter Beale and John Edwards known as the Phoenix Four.

The four directors had bought the car manufacturer from BMW for a token £10 five years earlier, and went on to take £42m in pay and pensions from MG Rover before it collapsed.

Deloitte and Einollahi face unlimited fines if the tribunal finds against them. The Phoenix Four were struck off as company directors for a combined 19 years after a £16m government investigation into the collapse of MG Rover raised serious questions about their actions.

A Deloitte spokesman said the allegations of misconduct 'concern limited aspects of our corporate finance advice on two transactions back in 2001 and 2002 We reiterate our belief that there is no basis for the executive counsel's allegations.'

A decision on the case could come as early as Tuesday.
