The first in a series on parental rights during employment, focusing on maternity leave and pay, examines the rights and responsibilities of both employer and employee while considering the timing of maternity leave and implications of statutory maternity pay

There are statutory minimum entitlements in place for employees who become pregnant and take maternity leave. It is open to employers to grant maternity benefits that are in excess of the statutory minimum.

Pregnant employees enjoy special protection in law from the beginning of their pregnancy through to the end of their maternity leave. This is known as the protected period.
