Stamp duty chancers warned by HMRC

HMRC plans to clamp down on ‘bogus stamp duty claims’ as Court of Appeal decision solidifies stamp duty land tax (SDLT) remains chargeable on homes under repair

Homebuyers are being told not to take advice from ‘rogue agents’ that are promoting ‘misleading SDLT repayment claims’ as the Mudan & Anor v HMRC appeal is thrown out at the Court of Appeal.

This issue specifically relates to properties that are being purchased in disrepair and are needing some TLC before being lived in.

Rogue agents are approaching individuals offering to reclaim some of the SDLT they paid as at the time of purchase the property should have been deemed non-residential due to it being uninhabitable.
