ECJ decision on FII group litigation

The European Court of Justice ruling on FII means the group action can continue in the UK courts

In response to a request from the UK Supreme Court, the European Court of Justice (ECJ) has ruled that legislation introduced in the UK in 2004, which retroactively abolished the extended limitation period available for Kleinwort Benson claims, was contrary to EU law. The judgment was delivered 5 September 2013 [Test Claimants in the FII Group Litigation v Inland Revenue Commissioners (Case C-362/12)].
