Employment tax updates: May 2015

In this month's key employment tax updates, trivial benefits rule for PAYE excluded from Finance Bill 2015, dispensation on expenses deferred to 2016 and HMRC online checking service for share schemes now live, reports Lesley Fidler, associate director at Baker Tilly 

PAYE: trivial benefits rule unchanged

One of the clauses published in the Autumn Statement and which appeared in the Finance Bill, but did not make it onto the statute book in Finance Act 2015, was a new measure to codify the trivial benefits rules.

It was removed before the Bill was enacted and it appears that there was concern about potential abuse of the rules as drafted.

So, for the time being, employers need to continue to refer to HMRC’s instructions for its own staff in EIM21860 and following pages when considering whether a trivial benefit of a welfare nature should be reported.
