Our client, a trustee of a discretionary trust, encountered a significant tax dispute with HMRC following a voluntary disclosure. The trust had received a lump sum payout from a life insurance policy held offshore, which was not declared due to a lack of proper tax advice from their advisers at the time.

Upon recognising this oversight, the client submitted a voluntary disclosure and believed that no penalties should be imposed as there was a reasonable excuse for the non-disclosure.
