PwC trainee was not unfairly dismissed

A trainee at PwC has lost a claim of constructive unfair dismissal after his contract was terminated over unauthorised absences, lack of sick notes and breach of contract

Yew Sun Soo was hired by PwC in September 2010 as part of a cohort of 15 to 20 graduate trainees. Ordinarily, a graduate training contract would last three years. By the end of the claimant’s employment in February 2022, over 11 years after he joined the firm, he had not completed his training.

At the employment tribunal, PwC stated that Soo acted in fundamental breach of contract in respect of the implied term of his employment contract relating to mutual trust and confidence.
