Pre-nuptial Agreements – ‘With None of my Worldly Goods&#8217

Suzanne Kingston reviews the status of pre-nuptial agreements after a recent Court of Appeal judgment.

The Court of Appeal handed down its eagerly-awaited judgment in the case of Radmacher v Granatino on 2 July 2009. Although the Court of Appeal had previously addressed procedural issues in cases surrounding pre-nuptial agreements in the 2007 case of Crossley, the most recent judgment is the leading authority on how the courts should view the existence of a pre-nuptial agreement when deciding how parties’ assets should be divided on divorce.
