Vitou: Deferred Prosecution Arrangements

DPAs could be preferable to criminal prosecutions for corporates but not employees, argues Barry Vitou

Amid banking scandals and calls for prosecution of bankers, the justice secretary Ken Clarke on Radio 4 said changes to the UK criminal justice system targeted at corporate law breaking were needed.

Clarke said: ‘We are very bad at prosecuting financial crime in this country, I suspect that financial crime is easier to get away with in this country than practically any other crime. [The banking industry] plainly needs a cultural change, as does the criminal justice system.’
